Our process · Step by step
What happens after you call.
Right now, your job is to heal. Ours is to handle everything else — the investigation, the paperwork, and the fight with the insurance company.
Step by step
The 10 steps of a Georgia injury case.
The legal process is more predictable than it looks. Almost every Georgia personal injury case — from a car accident to a fall or a trucking wreck — moves through the same stages, and a good lawyer does the heavy lifting at each one.
-
Free consultation & case review
It starts with a conversation — by phone, online, or in person, whenever works for you, 24/7. Tell us what happened. We'll listen, answer your questions, and give you an honest read on whether you have a claim and what your options are. There's no cost, no pressure, and no obligation. What we need from you: your account of the accident and any documents you already have — a crash report, photos, insurance information, or the name of a treating doctor. Don't have them yet? That's fine. We can get most of it ourselves.
-
Investigation & preserving the evidence
Once you hire us, the clock is what matters. We move quickly to lock down the proof before it disappears. That means obtaining the police report, photographing the scene and the vehicles, identifying and interviewing witnesses, and sending preservation letters so that dashcam footage, surveillance video, and — in trucking cases — electronic logging and engine data don't get erased or overwritten. In many cases this evidence is gone within days or weeks, which is why early action matters so much. What we need from you: nothing but the details you remember. We do the legwork.
-
Medical treatment & documentation
Your health comes first — always. Follow your doctors' advice, keep your appointments, and don't tough it out or skip care. Beyond helping you recover, consistent treatment creates the medical record that proves the full extent of your injuries. We gather those records and bills, coordinate with your providers, and make sure nothing about your injuries gets minimized. What we need from you: get the care you need, and tell us how you're feeling as things change. Gaps in treatment give the insurer an excuse to argue you weren't really hurt — so keep going until your doctor says you're done.
-
Establishing liability & damages
Two questions decide every injury case: who is at fault, and what are your losses worth? We build the answer to both. On liability, we assemble the evidence that shows the other party's carelessness caused your injuries. On damages, we account for everything — economic losses like medical bills, future care, lost wages, and reduced earning capacity, and non-economic harms like pain, suffering, and the things you can no longer do or enjoy. Georgia also follows a modified comparative-negligence rule, so part of our job is protecting you from being blamed for more than your fair share. What we need from you: keep us posted on medical costs, missed work, and out-of-pocket expenses so nothing is left off the ledger.
-
The demand & negotiation with the insurer
When your treatment has progressed far enough that we understand the true value of your case, we prepare a demand — a detailed package laying out the liability, your injuries, your losses, and what it will take to make you whole. Then we negotiate. Insurers routinely open low, hoping you'll take a fast, cheap settlement before you know what your claim is worth. We push back with the evidence and don't flinch. What we need from you: patience, and a promise not to accept any offer or sign anything from the insurance company without talking to us first.
-
Filing a lawsuit if they won't be fair
Not every case settles at the negotiation stage — and it shouldn't, if the offer is unfair. If the insurer refuses to treat you honestly, we file a lawsuit in the appropriate Georgia court. Filing isn't a threat; it's a tool. It puts the case on a track toward trial and often gets the other side to take the claim seriously for the first time. What we need from you: nothing new — we handle the pleadings and the filings. This step simply signals that we're prepared to see it through.
-
Discovery & depositions
Once suit is filed, both sides exchange information in a formal process called discovery. We request the other side's documents, send written questions, and take depositions — sworn, out-of-court testimony — of the people involved. You may be asked to answer written questions and to sit for your own deposition. It sounds intimidating, but it isn't: we prepare you thoroughly beforehand so you know exactly what to expect, and we're right beside you the whole time. What we need from you: honest, straightforward answers and a little of your time. Truthful and simple always beats clever.
-
Mediation & settlement
Before a trial, most Georgia cases go to mediation, where a neutral third party helps both sides work toward a resolution. By this point we've built a strong record, and the other side can see it. Many cases settle here — on far better terms than the insurer's early offers — because they'd rather resolve the case than face a jury. You always make the final call: no settlement happens without your approval. What we need from you: your input on whether an offer is one you're willing to accept. We'll give you our honest, experienced advice, but the decision is yours.
-
Trial, if that's what it takes
Some cases can only be made right in front of a jury. We prepare every case from day one as if it will be tried — and insurers know the difference between a firm that's ready for trial and one that isn't. If your case goes to court, we present the evidence, question the witnesses, and make the case for full and fair compensation to the jury. What we need from you: your trust and your presence. We'll walk you through every stage so nothing catches you off guard.
-
Resolution & getting you paid
Whether your case ends in a settlement or a verdict, the final step is getting the money into your hands. We handle the details: resolving medical liens and outstanding bills, negotiating down what's owed where we can, accounting for costs, and disbursing the balance to you. We explain every line of the settlement statement in plain English so you know exactly where every dollar went. What we need from you: a signature to close things out — and, we hope, the chance to see you move forward.
Your part
What we handle. What you do.
You don't have to become a legal expert. A few simple things go a long way toward protecting your case.
You let us do the talking. Don't give a recorded statement or sign anything without checking with us first.
You get medical care and follow your doctors' instructions — your recovery comes first.
You keep anything related to the accident — photos, receipts, medical bills, and the names of anyone who saw what happened.
You're honest and complete with us — about the accident, your injuries, and your history. Surprises help the other side, not you.
You keep us updated as things change — new symptoms, more missed work, a change in address or phone number.
You're careful on social media. A single photo or post can be taken out of context and used against you.
That's it — handle those, and let us do the rest. Every case is different, and prior results never guarantee a similar outcome. Want to know who you'd be working with before you pick up the phone? Meet your attorneys.
What it costs
No fee unless we win.
Worried you can't afford a lawyer? That's exactly why we work the way we do. We take personal injury cases on a contingency fee — in plain terms, that means:
You don't write us a check to get started, and you don't pay us by the hour.
We agree on that percentage in writing before we begin, so there are no surprises.
If there's no recovery, we don't get paid a fee for our work. The risk is on us, not you.
Lawsuits involve costs — filing fees, records, expert witnesses. We'll walk you through how those are handled and how they're accounted for out of any recovery, in writing, before you sign.
It lets anyone — regardless of their bank balance — take on a powerful insurance company with a serious lawyer in their corner. It also keeps us honest: we only get paid when you do, so our goal and yours are exactly the same — recovering the full value of your claim.
The consultation is always free, and there's no obligation to hire us. Contingency fees apply to attorney fees only; clients may be responsible for case expenses and court costs.
Common questions
Questions we hear at every step.
How long will my case take?
Some cases resolve in months; serious, permanent injuries can take a year or more. What we won't do is rush your case just to close it.
Read the answerWhat is my case worth?
It depends on your injuries, medical costs, lost income, and how the injury affects your life. Be cautious of anyone who promises a number up front.
Read the answerDo I have to go to court?
Most claims settle without a trial — and insurers tend to offer more when they know your lawyer is ready to try the case.
Read the answerWhat if I was partly at fault?
You may still have a case. Under Georgia's modified comparative negligence rule, you can recover as long as you were less than 50% at fault.

Georgia deadlines are real.
Most Georgia personal injury lawsuits must be filed within two years of the injury, and some claims — such as those against a city, county, or the State — carry much shorter notice deadlines, sometimes just a few months. Miss the deadline and you can lose the right to recover anything.
This is general information, not legal advice — deadlines and rules vary by case; contact us to confirm what applies to you.
